1. General Provisions
1.1. Terms and Definitions
In these Terms for the Provision of Medical and Laboratory Diagnostic Services, the following terms are used with the meanings set forth below:
Provider – the Limited Liability Company “Professor Feskov Clinic”, which provides medical and/or laboratory diagnostic services in accordance with the current legislation of Ukraine.
Customer – an individual who applies to the Provider for the purpose of receiving medical and/or laboratory diagnostic services, or, in cases provided for by the current legislation of Ukraine, their legal representative.
Confirming Actions – actions of the Customer that indicate their consent to comply with these Terms and the terms posted on the Provider’s Website. Such actions include, in particular:
- applying for medical and/or laboratory diagnostic services;
- placing an order for services;
- giving consent to medical interventions or examinations;
- making payment for services (including online payment);
- commencing the actual receipt of services;
- other actions indicating acceptance of these Terms.
Services – medical and/or laboratory diagnostic services provided by the Provider to the Customer at the clinic, laboratory, through the collection of biological material, as well as through the use of the Website and digital services (including for information, appointment booking, payment, and receipt of test results).
Provider’s Website – the official website of the Provider on the Internet, located at: https://feskov.ua/en
Parties – the collective designation of the Customer and the Provider when referred to jointly in these Terms.
2. Rights and Obligations of the Parties
2.1. The Provider shall:
- provide the Customer with medical and/or laboratory diagnostic services in a timely, high-quality, and complete manner in accordance with these Terms and the current legislation of Ukraine;
- provide the Customer with full and accurate information related to the procedure, terms, and specifics of the provision of services;
- inform the Customer of circumstances that make it impossible or temporarily hinder the provision of services;
- provide services based on the Customer’s request to the Provider (including via the Website, by phone, or directly at the Clinic).
2.2. The Provider has the right to:
- change the cost of services by posting updated information on the Provider’s Website or by any other available means. New prices shall enter into force from the moment of their publication, unless otherwise expressly stated by the Provider;
- unilaterally refuse to provide or terminate the provision of services to the Customer in cases including, but not limited to:
- the presence of medical contraindications;
- the need for an in-person medical consultation or additional examination;
- Customer requirements regarding the method or scope of services that may be deemed unacceptable, ineffective, or contrary to medical standards;
- other justified cases, with notification to the Customer;
- refuse to provide services if the Customer provides incomplete and/or inaccurate personal data, or if the Customer has outstanding debt for previously provided services.
2.3. The Customer shall:
- agree with the Provider on the date and time of service provision in the установленому порядку (prescribed manner);
- provide complete, current, and accurate contact details. The Parties recognize as proper contact details those provided by the Customer when contacting the Provider, placing an order, or making an online payment;
- appear or contact the Provider on the agreed date and time to receive the services;
- accept properly provided services;
- timely and in full pay for the Provider’s services in accordance with the current price list;
- when receiving services for a minor child, ensure accompaniment by a legal representative;
- ensure the confidentiality of the Authorization Data (order/analysis number, password, and email address) and not transfer them to third parties. The Customer bears responsibility for all actions performed using such Authorization Data.
2.4. The Customer has the right to:
- require timely and high-quality provision of services by the Provider in accordance with these Terms;
- receive information regarding the provision of services by contacting the Provider through the contact channels specified on the Provider’s Website;
- refuse to receive services or reschedule the date and time of their provision upon prior agreement with the Provider in accordance with the установленому порядку (established procedure).
3. Procedure and Terms for the Provision and Payment of Services
3.1. Procedure for the Provision of Services
The Provider delivers medical and/or laboratory diagnostic services based on the Customer’s request, made by booking through the Provider’s Website, by phone, directly at the Clinic, or by any other available method, on the date and time agreed by the Parties, taking into account the Provider’s specialists’ schedules.
Services may be provided:
- on the Provider’s premises;
- on the premises of partner institutions and departments;
- remotely (online) using the Website and other digital communication tools;
- with the use of digital services as auxiliary tools for booking, information, payment, and receiving test results.
The form, method, and place of provision of a specific service are determined depending on its nature and are agreed upon by the Parties at the time of booking or request by the Customer.
3.2. Cost of Services
The cost of services provided by the Provider is determined in accordance with the Provider’s Price List posted on the Provider’s Website and/or at the Clinic premises and is valid as of the date of the Customer’s actual payment for the relevant services.
3.3. Payment Procedure
Payment for services shall be made by the Customer in the national currency of Ukraine by one of the following methods:
by advance (pre)payment, including through the Provider’s Website using payment services;
by payment directly to the Provider;
by other methods not prohibited by the current legislation of Ukraine.
In the case of online payment, payment transactions are processed in accordance with the rules of the payment systems. The Provider does not store or process the Customer’s bank card details.
3.4. Refusal of Services, Rescheduling, and Refunds
If the Customer refuses to receive services that have already been paid for, the Customer has the right to:
- reschedule the service to another date and time upon prior agreement with the Provider; or
- receive a refund in the manner and within the time limits established by the current legislation of Ukraine and the rules of the relevant payment systems, taking into account the actual costs incurred by the Provider.
3.5. Acceptance of Services
If the Customer does not provide the Provider with a written, reasoned refusal to accept the services within 1 (one) business day from the date of their actual provision, the services shall be deemed to have been properly provided and accepted by the Customer without any remarks or claims.
3.6. Settlement of Disputes
If the Customer provides a reasoned refusal to accept the services, the Parties undertake to resolve any disputed issues through negotiations. If no agreement is reached, the dispute shall be resolved in accordance with the procedure established by the current legislation of Ukraine.
4. Miscellaneous
4.1. Confidentiality
Each Party undertakes to ensure the confidentiality of information received from the other Party in connection with the conclusion and performance of these Terms, including personal and medical data.
Disclosure, transfer to third parties, publication, or any other form of dissemination of such information is permitted solely with the Customer’s consent and/or in cases expressly provided for by the current legislation of Ukraine, regardless of the reasons for and date of termination of these Terms.
4.2. Limitation of Liability for Disclosure of Information
The Provider shall not be liable for the disclosure of information provided by the Customer when using the Website or other communication channels of the Provider if such disclosure occurred as a result of circumstances beyond the Provider’s control and which could not have been foreseen or prevented, including as a result of:
- unauthorized interference by third parties (hacker attacks);
- interception of information on the Internet;
- the Customer independently posting confidential information on third-party resources and/or websites;
- the Customer granting third parties access to their data.
4.3. Recording of Interactions
The Customer grants consent to the Provider to:
- record telephone conversations;
- store email correspondence and other forms of electronic communication;
- carry out audio and/or video recording during the provision of services (including online),
- solely for the purposes of quality control, ensuring security, and for use of such materials in the event of disputes or resolution of conflict situations between the Parties in accordance with the current legislation of Ukraine.
4.4. Provision of Services to Minors and Incapacitated Persons
The provision of services to minors or incapacitated persons shall be carried out exclusively with the participation and/or consent of their legal representatives in accordance with the requirements of the current legislation of Ukraine.
In such cases, the legal representatives act on behalf of and in the interests of the relevant person, are deemed to be the Customer within the meaning of these Terms, provide the necessary consents, and undertake to comply with these Terms in full.
